Apollo Rental Cars Rental Terms for travel between 21-Nov-2014 and 31-Mar-2018
Full payment is required at time of booking confirmation. Accepted credit cards are Visa and MasterCard. In certain branches a location fee is to be paid when collecting the car. This will be shown on the confirmation.
There is a non refundable deposit which will be kept for cancellations made prior to 48 hours before pick up will. Cancellations made within 48 hours of travel will be charged 1 day rental. No shows will also be charged 1 day rental.
In addition to this, where a client does not pick up their rental vehicle at the date and time confirmed on the reservation, Apollo reserves the right to charge a No Show fee equal to the cost of one rental day as per the reservation.

Summary of Rental Conditions
This document contains a brief summary of our rental conditions. The full details of our rental contract do apply. Rates quoted are in Australian dollars.
A Rental Day consists of a consecutive 24 hours.
When returning a vehicle a grace period of 29 Minutes is permitted, after which the customer is liable for an extra days hire at the current applicable daily rate.
No refunds will be given on unused days.
Vehicles must be collected and returned to the branches outlined on the clients booking confirmation. Transfers to and from the branch are not included in the rental price. It is the renter’s responsibility to get to and from the depot.
Administration Fees / Taxes
Our rates include 10% GST, Vehicle Registration Recovery Fee and Administration Fee Recovery
Please retain and present fuel receipt to supplier upon return of vehicle or penalty fees may apply.
Location Fee (LF) – Airport Locations
This fee is included in the Location Fee Rates.

It is requested that Flight numbers are provided for rental reservations with an airport pick up.

Authorised Driver Requirements
All reservations should be made in the name of the Authorised Driver/Main Renter. Renter name on Voucher MUST match the Renter name on booking.
Minimum Driver Age
The minimum driver age for all Australia Vehicles is 21 years.
Young Driver Surcharge (YDS)
This surcharge is included in our rates.
All Renters must present a full, valid national driver’s licence that has been held for at least one year.
Where a licence has two parts, photo card and paper, both parts of the licence must be presented. An overseas driver’s licence, issued in a language other than English, must be accompanied by a current International Drivers Permit (IDPs) or where in a country where IDP s are not issued official government approved translation document.
Restricted, Provisional or Probationary Licences are NOT accepted
All overseas drivers must present their passport at pick up of rental.
Additional Drivers are Free of Charge Minimum rental age and other requirements for additional drivers will be the same as for the main renter. Additional authorised drivers must be registered on the authority to drive form which would accompany the Rental Agreement.
One Way Rentals
One way rentals are permitted within Australia and the following conditions and fees apply.
Hertz Australia reserves the right with notice to change these fees at any time.
All one way fees are payable direct to the Hertz location at time of rental. It is not possible to prepay these fees or include them on voucher.
All requests for Optional Equipment MUST be made at time of reservation. Hertz Australia cannot guarantee availability of equipment if not pre booked. All Optional Equipment Rental Fees are to be paid locally at time of rental. Hertz Australia reserves the right with notice to amend the charges for all optional equipment.

Note: Purchase of AER does not cover the renter for damage and/or loss to the Neverlost units. Rates incorporating the Neverlost Unit do not cover the unit for loss or damage.
Neverlost units are available for One Way rentals at no additional cost. It is the renter’s responsibility to ensure that the Neverlost equipment is returned to the rental counter or left in the vehicle glove box at the end of the rental. If the renter needs to return the equipment outside of Hertz operating hours they must complete and sign the Neverlost addendum and place it inside the Neverlost carry case with the other Neverlost equipment and then place the Neverlost carry case in the glove box of the vehicle. Hertz will not acknowledge return of the equipment until the renter returns it to the counter or it is collected by a Hertz representative from the glove box of the vehicle.
Hertz Prepaid Toll Product
The Hertz Prepaid Toll product is available for renters to purchase locally on collection of rental and offers unlimited toll road driving for a fixed daily amount. If the Customer opts for the Prepaid Toll Product ALL toll fees will be paid directly by Hertz Australia.

Renters can choose to pay Tolls locally and must register themselves and their rental vehicle with the appropriate toll authority.
In the event that the renter has not purchased the Prepaid Toll product and fails to pay Tolls against their rental vehicle. Hertz will charge the renter for the applicable Tolls PLUS a Toll Infringement fee as detailed in the Administration Recovery Fee seciont.
Hertz Australia WIFI units are available for hire at selected locations. It can only be purchased locally and cannot be pre-booked through Hertz reservations. These units connect customers’ various digital devices (e.g. laptops, smart phones & tablet devices) to an Australian telephone network so that they can access web and phone based services without data roaming costs.
The cost of renting the unit includes a daily allowance of 150 megabytes of data.

Liability for Loss or Damage
Electronic Equipment is hired to the renters at their own risk. They are liable for any loss or damage during the hire. Purchase of AER does not cover the renter for damage and/or loss to the Wifi units.

Reservations on freesale must be made with at least 24 hours notice. Rentals within 48 hours of reservation are on a request basis only.

Damage Cover (DC)
Damage Cover (DC) is included in all rates and provides cover for accident damages to the Hertz vehicle and/or third party property. DC is subject to an Accident Damage Excess (ADE) as detailed below and valid as long as the renter complies with the standard rental terms and conditions.

ANY damage caused by total or partial immersion in water including crossing a waterway is considered FULL RESPONSIBILITY of the renter. Water damage other than the above will incur a full charge of the Accident Excess regardless of insurance options taken at time of booking or rental. Important Note: If the renter has their own insurance the Accident Damage Excess must be paid to Hertz in the event of an accident. It is the renter’s responsibility to claim this charge back through their own insurance company.
Third Party Property and Injury Insurance Cover
Third Party Property Liability Insurance is automatically covered under a third party property damage Master Policy executed by Hertz and is subject to the renter complying with all Terms and Conditions of the rental and payment of the Accident Damages Excess. Third Party Liability cover for personal injury is governed by separate Government legislation in each Australian State and Territory. The right to claim may be limited by the legislation and excesses may apply.
There are many factors relevant to a determination of which third party liability cover for personal injury will apply in the event of an accident, such as the state or territory in which a vehicle is registered, the state or territory in which the accident occurs and the state or territory in which another driver or injured person resides. Should an accident in which a person is injured occur, the renter must contact the police and Hertz.
This summary of the cover available throughout Australia is meant as a guide only and no warranty of accuracy or reliability is given or responsibility accepted by Hertz for the information contained below. In the event of an accident, the renter should make independent enquiries of the relevant insurer of the vehicle.
Queensland: Injured person or the dependents of a deceased person can bring claim for damages against a negligent party.
New South Wales: Compensation is available for persons injured or killed by the negligence of a motor vehicle driver. At fault drivers are not covered.
Western Australia: Damages may be claimed by persons injured or by the relatives of a person killed by the negligence of a motor vehicle driver.
South Australia: Damages may be claimed by persons injured or by the relatives of a person killed by the negligence of a motor vehicle driver.
Victoria: Combination of no fault and negligence indemnity. Statutory benefits in the nature of weekly payments during incapacity for work, impairment benefit annuities, medical and like expenses and death benefits may be available regardless of the question of fault. In addition, damages may be claimed by persons seriously injured or killed by the negligence of a motor vehicle driver.
Tasmania: Combination of no fault and negligence indemnity. No fault medical benefits, death benefits, disability benefits and disability allowances may be claimable. Injured persons or dependents of deceased persons can also bring claims for damages against negligent parties.
Northern Territory: Claims for damages may be brought by persons injured by the negligence of a motor vehicle driver or by the dependents of a deceased person. Entitlement to no fault statutory benefits restricted to residents of Northern Territory. Non residents may apply to the Board of the Territory Insurance Office to be treated as a resident.
Australian Capital Territory: Injured persons or the dependents of deceased persons can bring claim for damages against a negligent party.
As specific compensation amounts vary so widely depending on the circumstances of individual claims they cannot be quoted.
The following general driving restrictions apply. Further local driving restrictions may apply in remote areas and it is recommended that you check your intended itinerary with Hertz at time of booking and/or rental collection. Failure to adhere to Hertz driving restrictions may result in Damage Cover becoming invalid.
Unsealed Roads – See Also State Driving Restrictions below.
CARS, 2WD and AWD vehicles are not permitted to be driven on unsealed roads.
Exception 1: Where the road is a DIRECT access road to National Parks, State Parks, Holiday
Accommodation (including lodges) driving is permitted for access only except in Kimberley Region where 2WD are not permitted on any unsealed roads.
Renters however must exert caution as any damage caused may invalidate insurance.
Exception 2: Where a road is under repair driving is permitted. Renters however must exert caution as any damage caused may invalidate insurance.
Off Road driving is NOT permitted in any Hertz Vehicle
Hertz vehicles are NOT permitted to be driven on any Beach or exposed to Salt Water.
Renter will be liable for Full Responsibility relating to water damage – See Damage
Excess/Accident Excess Insurances
Night driving is not recommended in Remote regions including but not limited to Northern Territory, Kimberley Region Exmouth Region and Kangaroo Island.
This is a Road Safety Issue. If an accident occurs between Dusk and Dawn the renter will be responsible for any damage caused irrespective of circumstances and insurance cover.
If vehicles are to be driven into Alpine regions above the snow line, the purchase of ‘SNO’ cover is mandatory – See Optional Extras/Snow Cover
Only Group 4WD vehicles are permitted to be driven on the Mereenie Loop Road Vehicles are not permitted into Jim Jim Falls or Twin Falls
Hertz vehicles can be taken onto the Kangaroo Island Ferry. If damage occurs insurance may be invalid CARS and 2WD are not permitted in any unsealed roads on the Island
Hertz vehicles cannot be taken on Fraser Island
Hertz vehicles cannot be driven north of the Oodnadatta Track Including the following areas, Dalhousie Springs, Mount Dare, Witjira National Park, Pedirka Desert
2WD Vehicles can only be driven on sealed bitumen roads in the Kimberley Region.
A non waiverable excess of $5500 applies if damage occurs while driving on these routes.
Change of Drop Off Destination
If the renter wishes to change the drop off destination after the rental has commenced, they first must obtain authorisation from Hertz Reservations. Subject to the change being approved, a minimum additional charge of $700 will apply.
If the customer wishes to extend the rental whilst on hire, they must first obtain authorisation from Hertz Reservations who will advise of the additional costs. Rental extension is subject to fleet availability. Additional days will be charged, direct to the client, at the local “Extra Days” rate.
Failure to obtain authorisation will result in the renter being charged double the daily gross rental rate.
Administration Recovery Fee (AR)
An AR Fee will be charged to cover administration costs undertaken in respect of any rentals, where Hertz Australia are required to collect the costs associated with payments of taxes and duties for government bodies such as unpaid road tolls or driving infringement fines. The Administration Fee is charged in addition to the unpaid or infringement fines.

In the unlikely event of your vehicle being disabled, we offer a 24 hour Roadside Assistance service. Please call 1800 996 010 if this service is required.
If a breakdown occurs in any areas outside major cities including the Northern Territory, Roadside Assistance may take extended hours to fulfil.
Change Of Vehicle
Should the vehicle booked be unavailable through unforeseen circumstances, we reserve the right to substitute an alternative vehicle without prior notification and at no extra cost. This shall not constitute a breach of contract and does not entitle the renter to a refund.
Vehicles cannot be requested by make or model, only by vehicle category.
Limit of Liability
In the event of no alternative vehicle being available to the renter our liability is limited to a refund of the hire charge or in the case of mechanical failure (unless caused by the renter) the remainder of the hire period.
We reserve the right to refuse any rental at our discretion.
No animals are permitted in our vehicles, excluding guide dogs.
Smoking is not allowed in our vehicles.
Where a client does not pick up their rental vehicle at the date and time confirmed on the reservation, Apollo reserves the right to charge a No Show fee equal to the cost of one rental day as per the reservation.
We strongly recommend that renters ensure they take out the highest level of Travel Insurance.
All rentals are subject to a bond deposit which covers additional costs such as fuel, one way fees and optional extras. Hertz Australia accepts all major credit cards and debit cards and will authorise a deposit bond of $100 for credit card or $200 if paying by cash at time of rental. Third party credit cards are acceptable providing the card holder is present. A ‘Credit Card Authority’ form must be completed at the counter by the third party.
If the customer/authorised renter do not hold a credit card acceptable to Hertz, a cash deposit will be required. A minimum deposit of $400 will be required to cover the bond plus any additional service options taken by the customer. No Cash Refunds are issued at the Hertz Location. Refunds for cash deposits will be made by cheque issued by Hertz Australia head office and sent to the customer’s residential address at the end of the rental. Cash payments for purchased additional extras not included on the prepaid tour voucher are permitted however please note the following:
Cash Deposits are only accepted Monday – Friday between 0900-1700 hrs, excluding holidays.

On very rare occasions, a rate may be displayed incorrectly due to our, or a vehicle supplier's error. In such a case, if you book with us at a quoted rate that is incorrect, we will notify you of any price change and give you the option to proceed or cancel. We make every effort to keep information on our site up to date, but we cannot guarantee this website is free of errors or omissions and retain the right to update or change the information published at any time.
To the extent permitted by law we/the owners of this website will not be liable to you or to any third party (whether in contract, tort, or otherwise) for any direct, indirect or consequential loss or damage (including but not limited to any accident, injury, delay or loss of enjoyment) arising out of your reliance upon information contained on this website, including but not limited to your use (or inability to use) any products or services described or procured through this website.
When you pick up your vehicle, you will be required to sign a rental agreement with the supplier of the vehicle. Your rental and use of the vehicle will be governed by the terms of the rental agreement and any other documentation or information provided to you by the supplier at the time you pick up your vehicle. The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier's rental agreement or any other documentation provided to you by the supplier at the time of pick up.
While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.
Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice.
If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.
Vehicle capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.
In the event of cancellation, any deposit amounts paid at the time of booking are non-refundable.
If you are unsatisfied with our service, please contact us within 48 hours of placing your booking or request and we will work to resolve any issues and determine if compensation is due. In the event you have completed your rental and are unhappy with your vehicle, we are happy to assist you in seeking compensation from the operator of the vehicle.
